CFTC Staff Letter 00-50: No-Action Position on CPO and CTA Registration for REIT Hedging

The Division of Trading and Markets will not recommend enforcement action against the Directors of a real estate investment trust for failing to register as a commodity pool operator, provided the trust limits commodity interest trading to bona fide hedging, restricts initial margin and option premiums to no more than 1 percent of total assets, and ensures income from such trading does not exceed 5 percent of gross income. The Division also will not recommend enforcement action against the trust's manager for failing to register as a commodity trading advisor, subject to the condition that the manager does not provide commodity interest trading advice to any client other than the trust without prior written approval.
