CFTC Staff Letter 01-49: No-Action Position on Delegatee Status for Subsidiary of Securities Association

The Division of Trading and Markets will not recommend rejection of an application for designation as a Designated Contract Market or registration as a Derivatives Transaction Execution Facility solely because the proposed delegatee is a subsidiary of a national securities association pending registration as a futures association. If the Commission determines the application otherwise meets statutory requirements but has not completed its review of the delegatee's registration application, the Division will grant no-action relief from Section 5c(b) requirements. This relief permits the Designated Contract Market or Derivatives Transaction Execution Facility to rely on its demonstration of compliance with core principles through delegation while the Commission acts on the delegatee's registration.
