CFTC Staff Letter 04-06: Segregation and Net Capital Treatment of Funds at Sentinel Management Group

capital
safeguarding

The Division of Clearing and Intermediary Oversight confirms that funds held in the Seg I Account at the Bank of New York satisfy segregation requirements under Section 4d(a)(2) of the Commodity Exchange Act and Commission Regulation 1.20, allowing Client Futures Commission Merchants to include their proportionate interest in these funds in their daily segregated funds computations under Regulation 1.32. Additionally, Client FCMs may treat proprietary funds held in the Seg III Account as current assets for minimum adjusted net capital calculations under Regulation 1.17, provided Sentinel calculates daily haircuts per Regulation 1.17(c)(5)(v) and SEC Rule 15c3-1, and reports the Client FCMs' proportionate interests and applicable haircuts daily. This opinion is conditioned on Sentinel informing Client FCMs to report their Seg III interests as investments on financial reports filed with the Commission and self-regulatory organizations.
