CFTC Staff Letter 04-18: Post-Trade Allocation of Bunched Orders by Exempt CTAs

An associated person (AP) of an introducing broker (IB) who is also an exempt Commodity Trading Advisor (CTA) qualifies as an eligible account manager under Commission Rule 1.35(a-1)(5). This status permits the individual to place bunched orders on a contract market without specific customer account identification at the time of placement or execution report. Consequently, the AP may allocate trades from these bunched orders on a post-trade basis, provided they act in their capacity as an exempt CTA rather than as an AP. The interpretation applies to CTAs exempt from registration under Rule 4.14(a)(5) and (a)(10) who have not advised more than 15 persons in the preceding 12 months and have not held themselves out generally to the public.
