CFTC Staff Letter 05-21: No-Action Relief for Alternative Capital Deductions

The Division of Clearing and Intermediary Oversight will not recommend enforcement action against a futures commission merchant registered as a securities broker-dealer for using SEC-approved alternative market and credit risk capital deductions in its adjusted net capital calculations under Commission Rules 1.10 and 1.17. This relief applies provided the firm provides immediate written notice of specific SEC notifications, files copies of its SEC reports with the Division Director, and notifies the Division of planned withdrawals of excess net capital. The no-action position is withdrawn on the effective date of any subsequent Commission amendments to Rule 1.17 authorizing such mathematical models.
