The Division of Clearing and Intermediary Oversight grants commodity pool operators of offshore Cayman Islands pools relief to prepare annual financial statements using International Financial Reporting Standards instead of US GAAP. This authorization applies to pools operating under Commission Regulation 4.7, provided the operator adheres to specific conditions including the use of AICPA valuation methods, reporting realized and unrealized gains through the Statement of Operations, and preparing a condensed schedule of investments. The exemption remains valid only upon continued compliance with these conditions and requires immediate written notification to the Division if the pools' operations or activities change from those represented.
