The Division of Clearing and Intermediary Oversight grants a commodity pool operator (CPO) of an offshore pool relief to prepare annual financial statements using International Financial Reporting Standards (IFRS) instead of US GAAP. This exemption applies to a pool organized under the laws of 'X' that has filed an exemption under Commission Regulation 4.7. The CPO must comply with specific conditions, including using valuation methods from the AICPA Audit and Accounting Guide, reporting realized and unrealized gains and losses through the Statement of Operations, preparing a condensed schedule of investments, and reporting special allocations of partnership equity in accordance with CFTC Interpretative Letter 94-3. The relief is subject to continued compliance with these conditions and requires immediate written notification to the Division if operations or activities change from those represented.
