The Division of Clearing and Intermediary Oversight grants the commodity pool operator of offshore pools A, B, and C relief to prepare annual financial reports using International Financial Reporting Standards instead of US generally accepted accounting principles. This exemption applies to pools operating under Commission Regulation 4.13(a)(4) and is subject to conditions requiring the use of specific valuation methods, reporting of realized and unrealized gains and losses, and preparation of a condensed schedule of investments. The relief is contingent upon continued compliance with these conditions and immediate written notification to the Division if the pools' operations or activities change.
