The Division of Clearing and Intermediary Oversight grants commodity pool operators relief to prepare annual financial statements using UK GAAP instead of US GAAP for offshore pools operating under Commission Regulation 4.7. This authorization applies to pools organized under the laws of 'Y' and is contingent upon the CPO's continued compliance with specific conditions, including the use of AICPA valuation methods, reporting realized and unrealized gains through the Statement of Operations, preparing a condensed schedule of investments, and reporting special allocations of partnership equity per CFTC Interpretative Letter 94-3. The CPO must notify the Division in writing immediately if operations or activities change from those represented, and the relief does not exempt the CPO from other applicable Commission regulations.
