CFTC Staff Letter 12-38: No-Action Letter on Delayed Compliance Date for Amended Part 4

The Division of Swap Dealer and Intermediary Oversight will not recommend enforcement action against commodity pool operators of Funds of Funds for failure to register until the later of June 30, 2013, or six months after the issuance of revised guidance on de minimis thresholds under Regulations 4.5 and 4.13(a)(3). Eligible operators must submit a signed claim via email to dsionoaction@cftc.gov before December 31, 2012, stating that their direct commodity interest exposure does not exceed specified regulatory levels and that they did not reasonably know their indirect exposure exceeded those limits. This relief applies only to pools registered under the Investment Company Act of 1940 or compliant with Regulation 4.13(a)(3)(i), (iii), and (iv), and does not excuse compliance with other applicable requirements such as antifraud provisions.
