2014-10-08 | CFTC Staff Letter 14-123Added · Updated
The CFTC Division of Clearing and Risk grants ICE Clear Europe Limited no-action relief from the requirement to execute the standard Template Acknowledgment Letter under Regulation 1.20(g)(4) for customer accounts held at the Bank of England, permitting the use of a modified BoE Acknowledgment Letter instead. The Division also grants an exemption from the regulatory capital requirements of Regulation 1.49(d)(3)(i), allowing ICE to hold customer funds at the Bank of England despite the central bank not meeting the $1 billion capital threshold applicable to commercial depositories. ICE and the Bank of England must execute and submit the BoE Acknowledgment Letter to the Commission within three days of execution, with this process required to be completed no later than December 1, 2014.
