CFTC Staff Letter 14-157: Extension of Time-Limited No-Action Position for FCMs Regarding Depository Acknowledgement Letters

The Division of Swap Dealer and Intermediary Oversight extends its time-limited no-action position until April 30, 2015, allowing futures commission merchants (FCMs) additional time to comply with regulations requiring acknowledgement letters from depositories. This extension applies to FCMs registered with the Commission that have not yet obtained required standard form acknowledgement letters because depositories require the Commission to execute a standard on-line access agreement before providing direct, read-only electronic access to transaction and account balance information. The Division will not recommend enforcement actions against FCMs for failing to obtain these letters solely due to the lack of an executed on-line access agreement between the FCM’s depository and the Division. This relief is based on representations made to the Division and does not excuse reliance on it from compliance with other applicable requirements.
