The Divisions of Swap Dealer and Intermediary Oversight, Clearing and Risk, and Market Oversight extend the no-action relief for Non-U.S. Swap Dealers until September 30, 2017, or the effective date of any Commission action, whichever is earlier. This relief applies to Covered Transactions, defined as swaps with non-U.S. persons that are not guaranteed or conduit affiliates of a U.S. person, where personnel or agents located in the United States arrange, negotiate, or execute the transaction. Non-U.S. Swap Dealers are exempt from Transaction-Level Requirements for these transactions, except for multilateral portfolio compression under regulation 23.503 and swap trading relationship requirements under regulation 23.504 when the counterparty is another Non-U.S. Swap Dealer. The Divisions will not recommend enforcement actions against Non-U.S. Swap Dealers for failing to comply with the specified requirements during this period.
