CFTC Staff Letter 17-06: Time-Limited No-Action Relief from Regulation 150.4(c) Notice Filing Requirements

The Division of Market Oversight grants time-limited no-action relief from the notice filing requirements of Commission Regulation 150.4(c) for persons eligible to rely on an exemption from aggregation under § 150.4(b). This relief applies until 12:01 a.m. eastern standard time on August 14, 2017, during which the Division will not recommend enforcement actions against entities failing to comply with the new notice filing and certification requirements. Upon the expiration of this relief, each person or entity intending to rely on an aggregation exemption must file a notice as required under § 150.4(c). The relief does not excuse compliance with other applicable requirements under the Commodity Exchange Act or Commission regulations.
