The Division of Swap Dealer and Intermediary Oversight grants no-action relief from commodity pool operator and commodity trading advisor registration to a private university regarding its collective management of an endowment fund and the operation of planned giving accounts. The relief covers the university's management of assets from affiliated organizations commingled with its endowment, as well as its administration of pooled income funds and charitable remainder trusts for donors. This decision applies to the university's activities involving these specific investment vehicles and does not extend to other entities or general public solicitations.
