The Division of Clearing and Risk extends no-action relief for Shanghai Clearing House regarding Section 5b(a) of the Commodity Exchange Act until July 31, 2022, or until the Commission exempts the entity from registration as a derivatives clearing organization. The relief scope is expanded to permit U.S. persons to clear all swaps accepted by Shanghai Clearing House, removing previous restrictions on renminbi-denominated interest rate swaps not subject to mandatory clearing in the People’s Republic of China. This extension allows time for Shanghai Clearing House to update its exemption application while maintaining compliance with daily reporting conditions specified in prior correspondence.
