CFTC Staff Letter 21-30: No-Action for Delayed Part 45 Reporting and Part 43 Exemption for LIBOR to RFR Transition

The Division of Data will not recommend enforcement against entities for failing to timely report the change in floating rate under regulation 45.4 for uncleared swaps referencing Swiss Franc, Euro, British Pound Sterling, or Japanese Yen LIBOR, provided reporting occurs no later than 5 business days after December 31, 2021. The Division also will not recommend enforcement for failure to report such transactions under regulation 43.3 when they transition from LIBOR to a risk-free rate plus a spread adjustment. This relief applies to swaps modified after execution to incorporate ISDA LIBOR fallback provisions.
