Rule · CFTC · 2 Dec 1987 · CFTC Staff Letter 87-09
The Division of Trading and Markets grants no-action relief from specific risk disclosure and discretionary authorization requirements in rules 30.6 and 166.2 for commodity futures commission merchants and introducing brokers regarding clients solicited prior to January 4, 1988. FCMs and IBs must include the prescribed risk disclosure statement in monthly account statements for transactions occurring between December 1987 and March 1988. Existing discretionary authorizations for these clients do not need to be amended to expressly include foreign futures and options transactions unless new account documentation is requested or warranted. This relief does not affect obligations for clients solicited on or after January 4, 1988, nor does it diminish other regulatory duties such as antifraud provisions.
