CFTC Staff Letter 96-19: Relief for CPOs to Treat Non-QEP Investors as Qualified Eligible Participants

The Division of Trading and Markets permits registered commodity pool operators X and Y to treat specific non-Qualified Eligible Participant investors as QEPs for purposes of Rule 4.7(a) relief. This no-action relief applies provided each non-QEP investor consents in writing to being treated as a QEP. The Division will not recommend enforcement action against X and Y for admitting these investors, who possess futures experience, familiarity with the fund's management, or close family relationships with the fund's principal, despite not meeting standard QEP definitions. This relief is limited to the operation of the Fund and does not excuse compliance with other Commodity Exchange Act provisions or regulations.
