CFTC Staff Letter 96-30: Relief for CPOs Allowing Non-QEP Investors in Foundation and Trust Pools

The Division of Trading and Markets permits a registered commodity pool operator to treat non-qualified eligible participants as qualified eligible participants for the purpose of claiming relief under Rule 4.7(a). This relief applies to non-qualified eligible participants consisting of a foundation and two charitable remainder trusts established as part of the operator's financial and estate planning, provided the operator makes the investment decisions for these entities. The Division will not recommend enforcement action against the operator for treating these investors as qualified eligible participants, subject to the condition that each non-qualified eligible participant provides written consent to such treatment. The operator remains subject to all other applicable requirements of the Commodity Exchange Act and Commission regulations, including antifraud provisions and reporting requirements.
