CFTC Staff Letter 97-06: No-Action Relief for Employee Investment Trust QEP/QEC Treatment and CPO Registration

The Division of Trading and Markets will not recommend enforcement action against the trustees of the S Trust for failing to register as a commodity pool operator under Section 4m(1) of the Act. The Division also will not recommend enforcement against S, T, Y, or U for treating the S Trust as a qualified eligible participant or qualified eligible client under Rule 4.7, despite participants not meeting standard criteria. This relief permits the trust to invest in pools X and V, which in turn invest in pool W, subject to conditions including written participant confirmations and joint liability undertakings.
