CFTC Staff Letter 97-45: No-Action Relief from Acknowledgment Letter Requirements for FCMs

The Division of Trading and Markets will not recommend enforcement action against a Futures Commission Merchant (FCM) for failing to obtain and retain an acknowledgment letter from a U.S. clearing organization regarding the treatment of customer funds and the secured amount, provided the clearing organization has adopted and submitted for Commission approval rules requiring the segregation of all funds held on behalf of customers. This relief applies specifically to the requirements under Commission Rules 1.20(a) and 30.7(c)(5) and does not excuse FCMs, clearing organizations, or depositories from compliance with any other applicable provisions of the Commodity Exchange Act or Commission rules. FCMs remain responsible for obtaining acknowledgment letters from banks, trust companies, or other FCMs with which they deposit customer funds, as well as for the treatment of the secured amount in accordance with Rule 30.7.
