CFTC Staff Letter 97-98: No-Action Relief for CPO Investment Limitation and CPO/CTA Registration

The Division of Trading and Markets will not recommend enforcement action against the Adviser for claiming relief under Rule 4.7(a) despite an investment by a limited partnership containing non-Qualified Eligible Participant trusts that exceeds the ten percent asset limitation. The Division also will not recommend enforcement action against the general partners of the limited partnership for failing to register as commodity pool operators or commodity trading advisers, subject to conditions that the limited partnership invests only in the specified pool and admits no new limited partners. This relief is contingent upon the trustees of the trusts providing written consent to be treated as Qualified Eligible Participants.
