CFTC Staff Letter 99-08: No-Action Position on Clearing Activities for Eurex Deutschland

The Division of Trading and Markets will not recommend enforcement action against X for failing to register as a futures commission merchant (FCM) when clearing customer omnibus accounts of U.S. FCMs trading on Eurex Deutschland terminals located in the United States. This relief is conditioned on compliance with the terms of CFTC Interpretative Letter No. 87-7 and CFTC Letter No. 89-11, as well as all applicable provisions of the Act and Commission rules, including antifraud provisions. The Division declines to provide no-action relief for clearing the proprietary accounts of non-FCM U.S. based Eurex members or for clearing proprietary trades of registered FCMs without registration or Rule 30.10 relief.
