CFTC Staff Letter 99-17: Denial of No-Action Relief for Including Proprietary Accounts in Composite Performance Tables

The Division denies a request to include proprietary trading results in a composite performance table or to exempt the filer from restating historical records. Tables must be restated for all periods where the accounts are proprietary in nature, although accounts may be treated as customer accounts for the period prior to the owners becoming associated persons. The Division will not grant no-action relief to consider these accounts as non-proprietary or to apply prospective restatement only.
