CFTC Staff Letter 99-21: CTA Performance Presentation Requirements for Interest Income and Wrap Fees

A Commodity Trading Advisor must include interest income in total performance calculations if the advisor is directly responsible for the money management strategy generating that income, but must exclude it if the client retains control over the funds. When calculating performance for disclosure documents, a Commodity Trading Advisor must deduct the portion of wrap fees attributable to its share of trading expenses, while excluding any CPO management or incentive fees contained within those wrap fees. If the application of these principles results in materially different rates of return among accounts within the same trading program, the performance must be presented in separate tables in compliance with Commission Rule 4.35(a)(3)(ii).
