CFTC Staff Letter 99-32: Interim Financial and Segregation Interpretation No. 4-2 Risk-Based Auditing

Designated self-regulatory organizations (DSROs) are permitted to implement risk-based auditing procedures in lieu of the biennial full scope financial audits and specific paragraphs of Financial and Segregation Interpretation No. 4-1. This interim modification allows DSROs to determine examination frequency and scope based on the financial and operational risks posed by member-futures commission merchants (FCMs), including cycles of nine to eighteen months. DSROs must document the scope-setting process, ensure examinations cover capital, segregation, and reporting rules, and notify the Division if fieldwork exceeds five months. All other provisions of Interpretation 4-1 and its addenda remain in effect during this interim period.
