Rule · CVM · 8 Dec 2006
Securitizing companies and lead institutions must limit real estate credit exposure to 20% per debtor, filing audited financial statements with the CVM within three months of year-end unless CRIs exceed R$1,000,000 or target fewer than 20 investors. Offers below R$300,000 per unit require fiduciary regimes and occupancy permits, while provisional registration for larger units cancels automatically if definitive registration is not requested within 30 days. The intermediary must ensure secondary market compliance, and splitting CRIs is prohibited without filing required debtor financial statements. This instruction amends CVM Instruction No. 414/04 and enters into force 90 days after publication.
