Extension of Time-Limited No-Action Relief from the Clearing Requirement for Swaps Entered into by Cooperatives

The Division of Clearing and Risk extends the time-limited no-action relief provided in the June 7 No-Action Relief until July 19, 2013. During this period, the Division will not recommend that the Commission commence an enforcement action against a person for failure to comply with the clearing requirement for credit default swaps or interest rate swaps, provided specific conditions are met. These conditions require one counterparty to be an exempt cooperative and the swap to be entered into with a member in connection with originating loans or to hedge commercial risk related to loans to members.
