FINRA Amends Arbitration Codes to Accelerate Proceedings for Parties Aged 70 or Older or with Serious Health Conditions

FINRA adopted new Rules 12808 and 13808 to the Codes of Arbitration Procedure, establishing accelerated processing for parties aged 70 or older or those with a certified serious health condition. The amendments shorten default deadlines, including reducing the time to serve an answer from 45 to 30 days, arbitrator list responses from 20 to 10 days, and discovery responses from 60 to 30 or 35 days. Panels must endeavor to render an award within 10 months of the eligibility determination and schedule proceedings consistent with that timeframe. These changes apply to arbitration cases filed on or after March 30, 2026.
