FINRA Amends Rules to Allow Video Conference Hearings Before OHO and NAC
FINRA amended FINRA Rules 1015, 9261, 9341, 9524, 9830, and Funding Portal Rule 900 to permanently authorize the Office of Hearing Officers and the National Adjudicatory Council to conduct hearings via video conference. This authority applies when in-person proceedings may endanger participant health or safety, are impracticable due to events like natural disasters, or for other reasons in NAC oral arguments, provided no party demonstrates material disadvantage. The amendments allow these bodies to order video conferences sua sponte or upon motion by the parties, with in-person hearings remaining the default method. These changes became effective on August 23, 2023.
