Policy Statement Concerning Cooperation by Individuals in Its Investigations and Related Enforcement Actions

The Securities and Exchange Commission amends 17 CFR Part 202 by adding Section 202.12, which establishes an analytical framework for evaluating cooperation by individuals in investigations and related enforcement actions. The framework requires the Commission to assess four considerations: the assistance provided, the importance of the underlying matter, the societal interest in holding the individual accountable, and the individual's profile. This policy statement becomes effective on January 19, 2010.
