Rescission of Policy Relating to the Acceptance of Settlements in Administrative and Civil Proceedings

The Commodity Futures Trading Commission rescinds a 1998 policy that previously prohibited the acceptance of settlement offers where respondents continued to deny allegations of misconduct. This final rule repeals Appendix A to Part 10 of its regulations, thereby allowing the Commission to enter into settlements containing neither-admit-nor-deny provisions. The Commission also announced it will not enforce existing neither-admit-nor-deny provisions in previously entered settlements and will not seek to reopen cases following breaches of such terms.
