The staff of the Division of Market Regulation will not recommend enforcement action to the Commission under Rule 10b-10 if Dealer Subscribers rely on electronic trade confirmations generated and delivered through the TradeWeb System to satisfy their obligations for transactions in debt securities. This relief applies provided that each electronic confirmation includes all information required by Rule 10b-10 and that Users consent in writing to receive confirmations electronically. The staff position is limited to enforcement action under Rule 10b-10 and does not express legal conclusions regarding the applicability of other federal securities laws.
