Securities and Futures (OTC Derivative Transactions – Clearing and Record Keeping Obligations and Designation of Central Counterparties) Rules

Authorized institutions, approved money brokers, and licensed corporations must centrally clear specified OTC derivative transactions via a designated CCP within one business day (T+1) if their average total position exceeds US$20 billion. The clearing obligation applies to transactions entered into on or after 1 July 2017, with record-keeping required for at least five years post-maturity. Entities must notify the HKMA or SFC of threshold breaches within 60 days, submit exemption notices for affiliates or jurisdictions adhering to strict 5% and 10% position limits, and provide cessation notices when exemptions lapse.
