The Securities and Exchange Commission adopts an interim final rule to implement the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 by adjusting for inflation the maximum civil monetary penalties under several key securities statutes. This rule establishes revised penalty amounts for violations of the Securities Act of 1933, the Securities Exchange Act of 1934, the Investment Company Act of 1940, the Investment Advisers Act of 1940, and certain penalties under the Sarbanes-Oxley Act of 2002. The adjustments, which apply to all penalties imposed after August 1, 2016, utilize a statutory catch-up calculation based on the Consumer Price Index to ensure the penalties maintain their deterrent effect.
