Inflation Adjustment of Civil Monetary Penalties

The Department of the Treasury’s Office of Foreign Assets Control (OFAC) issued a final rule effective January 15, 2025, to adjust civil monetary penalties for inflation pursuant to the Federal Civil Penalties Inflation Adjustment Act. This action updates maximum penalty amounts for statutes including the Trading With the Enemy Act, the International Emergency Economic Powers Act, and the Foreign Narcotics Kingpin Designation Act, as well as recordkeeping penalties. The adjustments are calculated using the Consumer Price Index for all Urban Consumers and are applied to various sanctions regulations across 31 CFR without prior public comment.
