Amendment to Municipal Securities Disclosure

The Securities and Exchange Commission amends Rule 15c2–12 to require brokers, dealers, or municipal securities dealers acting as underwriters to reasonably determine that issuers or obligated persons have agreed to provide continuing disclosure documents solely to the Municipal Securities Rulemaking Board instead of to multiple nationally recognized municipal securities information repositories and state information depositories. The amendments mandate that such information be provided in an electronic format accompanied by identifying information as prescribed by the Municipal Securities Rulemaking Board. The rule becomes effective on July 1, 2009, and simultaneously withdraws previously proposed amendments that would have eliminated the Municipal Securities Rulemaking Board as a submission location.
