Amendment to Rule 102(e) of the Commission's Rules of Practice

The Securities and Exchange Commission amends Rule 102(e)(1)(ii) to clarify the standard for determining when accountants engage in improper professional conduct. The amendment defines such conduct as intentional or knowing conduct, including reckless conduct, that results in a violation of applicable professional standards, or negligent conduct consisting of a single instance of highly unreasonable conduct under heightened scrutiny or repeated instances of unreasonable conduct indicating a lack of competence. This final rule becomes effective on November 25, 1998, and applies to all proceedings considered after that date.
