Amendments to Regulation SHO

The Securities and Exchange Commission adopts an interim final temporary rule requiring participants of a registered clearing agency to deliver securities by settlement date or, if a fail to deliver position occurs, to immediately purchase or borrow securities to close out the position by the beginning of regular trading hours on the settlement day following the day the fail occurred. Participants that fail to comply with this close-out requirement, along with any broker-dealer receiving trades for clearance and settlement, are prohibited from accepting short sale orders or effecting short sales in the security without first borrowing the security until the fail to deliver position is closed out. The rule is effective from October 17, 2008, until July 31, 2009, with comments due by December 16, 2008.
