CFTC No-Action Relief for Consolidated Reporting by CPOs of Registered Funds with Controlled Foreign Corporations

The Division of Swap Dealer and Intermediary Oversight will not recommend enforcement against commodity pool operators of registered funds that trade in commodity interests through wholly-owned controlled foreign corporations consolidated for financial reporting. This relief permits filing consolidated reports under Regulation 4.27(c) and submitting consolidated annual reports under Regulation 4.22(c) to the National Futures Association in lieu of separate filings for the controlled foreign corporations. Eligible operators must file a claim with the Division via email by the end of the next applicable reporting period or fiscal year following the Compliance Date to perfect the use of this relief.
