CFTC Staff Letter 15-01: Time-Limited Extension of No-Action Relief for Reporting Identifying Information Under Parts 20, 45 and 46

The Division of Market Oversight extends the expiration date of no-action relief provided in CFTC Letter No. 13-41 until 12:01 a.m. eastern standard time on January 16, 2016, or until the reporting party no longer holds the requisite reasonable belief regarding privacy law consequences. This extension applies to members of the International Swaps and Derivatives Association and other similarly situated persons with reporting obligations under Parts 20, 45, or 46 of the Commission’s regulations. The Division replaces the definition of Part 20 Identifying Information to include data elements for New Form 102S, while maintaining all other terms and conditions of the original relief. The relief permits Reporting Counterparties and Reporting Entities to mask specific counterparty information in Enumerated Jurisdictions, provided they previously satisfied all conditions of Letter No. 13-41 and obtained formal responses from relevant non-U.S. regulators.
