CFTC Staff Letter 15-50: Interpretation of Part 39 Consistency with PFMIs

The CFTC Division of Clearing and Risk interprets Part 39 regulations to incorporate all standards set forth in the Principles for Financial Market Infrastructures (PFMIs) and to be fully consistent with them. This interpretation requires Systemically Important Derivatives Clearing Organizations (SIDCOs) and Subpart C Derivatives Clearing Organizations (DCOs) to manage risks associated with exchange-of-value settlement services and link arrangements in accordance with PFMIs Principles 12 and 20. Additionally, these entities must utilize central bank services when practicable and conduct due diligence on custodian banks consistent with PFMIs Principles 7 and 16, including full disclosure of investment strategies to market participants.
