CFTC Staff Letter 20-42: No-Action Position for Brexit Transition Period Swap Transfers

The Commodity Futures Trading Commission will not recommend enforcement action against swap dealers for failing to comply with margin or clearing requirements when transferring legacy swaps to affiliates solely in response to the end of the Brexit transition period. This relief applies to Margin Legacy Swaps and Clearing Legacy Swaps provided the amendments do not modify payment calculation methods, maturity dates, or notional amounts. The permitted amendments must take effect no earlier than the letter's date and no later than one year after the Brexit transition period expiration.
