1995-07-24 | CFTC Staff Letter 95-91Added · Updated
The Division of Trading and Markets will not recommend enforcement action against entity X for failure to register as a commodity trading advisor when providing advice to the Cayman Islands-based Fund, provided X is registered as an investment adviser under the Investment Advisers Act of 1940. This relief applies only if the Fund contains no United States persons as investors, operates outside the United States, and complies with Rule 4.5(c)(2). The Division may make special calls to demonstrate compliance, and X remains subject to antifraud provisions, reporting requirements, and operational rules despite the exemption.
