CFTC Staff Letter 97-72: No-Action for CPO Claiming QEP Status for Joint Account Under Rule 4.7(a)

The Division of Trading and Markets will not recommend enforcement action against a registered commodity pool operator (CPO) for continuing to claim relief under Rule 4.7(a) when admitting a joint account that is not a qualified eligible participant (QEP). This relief applies provided the joint account owners consent to the account being treated as a QEP. The CPO remains subject to all other applicable requirements under the Commodity Exchange Act and Commission regulations.
