CFTC Staff Letter 98-42: Status of DTB No-Action Letter Regarding Terminal Placement Following Merger with SOFFEX

The Division confirms that eleven specific firms identified in an April 30, 1998 letter remain eligible to rely on the February 29, 1996 no-action position for placing DTB computer terminals in the U.S., subject to existing conditions. Any entity other than these eleven firms, including current or future SOFFEX members becoming DTB or Eurex members, must obtain separate written approval from the Division before placing terminals in the U.S. The no-action position is strictly limited to DTB futures and options products and does not permit trading SOFFEX products or any new products developed by DTB or Eurex on U.S. terminals without prior written approval. Furthermore, DTB and Eurex members will not be grandfathered under any new regulatory scheme and must comply with applicable provisions of future rules to continue or apply for new terminal placements.
