Circular Issued by the Securities and Futures Commission on Margin Financing Activities Disguised as Investments
The Securities and Futures Commission issued a circular warning registered institutions against facilitating securities margin financing arrangements by unlicensed persons to circumvent regulatory requirements. The regulator observed that some licensed corporations aided and abetted unlicensed affiliates or third parties to provide such financing under the guise of investments, which constitutes illegal activity. Institutions are advised to heed these warnings as aiding and abetting illegal conduct may jeopardize the fitness and properness of licensed or registered persons.
