Class Relief for Fixed Income Exchange-Traded Funds

The Division of Market Regulation grants exemptive, interpretive, and no-action relief to Fixed Income ETFs from Rules 10a-1, 10b-17, 101 and 102 of Regulation M, and Rule 200(g) of Regulation SHO. Eligible funds must be registered open-end investment companies or unit investment trusts that continuously redeem Creation Unit Aggregations of at least 50,000 shares or $1 million in value, and publicly disseminate intra-day proxy values. Relief is contingent on specific portfolio composition requirements, such as limiting the weight of individual component securities and maintaining a minimum number of non-affiliated issuers, unless the fund holds only investment-grade non-convertible fixed income securities.
