Customer Protection-Reserves and Custody of Securities; Delegation of Authority to the Director of the Division of Market Regulation

The Securities and Exchange Commission amends rule 15c3–3 to permit broker-dealers to pledge collateral designated by Commission order, expanding beyond the current requirements of cash, U.S. Treasury bills or notes, and irrevocable bank letters of credit. The Commission delegates authority to the Director of the Division of Market Regulation to issue orders exempting specific collateral types from these requirements, provided the collateral is substantially comparable to previously exempted types. The amendments to rules 15c3–3 and 30–3 become effective on April 16, 2003.
